  • First-offense DUI (misdemeanor DUI): First-offense DUI can result in penalties including 10 days to six months in jail (minimum jail time may be reduced to 24 hours with participation in an alcohol treatment/diversion program), 90 days to 360 days license suspension, fines and other consequences.
  • Second-offense DUI (misdemeanor DUI): A conviction for second-offense DUI can result in 30 days to 90 days in jail, one-year license suspension, costly fines and other penalties.
  • First-offense extreme DUI (misdemeanor DUI): Driving under the influence with a blood alcohol content (BAC) of .15 or higher can result in elevated penalties for extreme DUI, including a minimum 30 days in jail, 90 days license suspension, enhanced fines and surcharges and other penalties
  • Second-offense extreme DUI (misdemeanor DUI): Second-offense extreme DUI (BAC of .15 or higher) can result in elevated penalties including 120 days in jail, one-year driver's license revocation, costly fines and surcharges and other consequences.
  • Aggravated DUI (felony DUI): Aggravating factors, such as DUI while on a suspended license, DUI with a minor in the vehicle or DUI with two or more prior DUI convictions within the past 84 months (seven years) can result in enhanced charges and penalties for aggravated DUI. Penalties for third-offense DUI within seven years (aggravated DUI) include a minimum four months in jail, three-years license revocation, costly fines and surcharges and other consequences.
