Rule 32 Post-Conviction Relief

After pursuing a direct appeal with the federal or Arizona Court of Appeals and then the Supreme Court unsuccessfully, you can apply for post-conviction relief under Rule 32 if you meet any of the following grounds:

  • The conviction or sentence is in violation of the Constitution of the United States or the State of Arizona's constitution
  • The court lacks the appropriate jurisdiction to render judgment or impose sentence
  • The sentence imposed exceeds the maximum allowed by law
  • You continue to be held in custody after the sentence expired
  • Newly discovered material facts probably exist that would have more than likely changed the verdict or sentence
  • You failed to appeal, and it was not your fault that you did not appeal
  • There has been a significant change of law that if applied to the your case would probably overturn the your conviction or sentence
